New terms apply to each User only after release and that User’s express acceptance.

I. PUBLISHER

Publisher and data controller: WPCAKE LLC. Contact: support@humfee.com. Website: https://humfee.com.

II. DEFINITIONS

Section 2

For the purposes of these Terms:

BETA — a test, pre-production or development version of the Application.

Account — an individual User account.

User — a person using HUMFEE.

HUMFEE POINTS (HP) / Points — units of the loyalty program awarded for specified activities.

Reward — a product, service, code, digital benefit, discount or other benefit obtainable in exchange for Points.

Program — the HUMFEE POINTS Program.

Referral Program — a mechanism for receiving bonuses for successfully inviting new Users.

Qualifying Activity — genuine User activity meeting the conditions for awarding Points.

Partner — an independent entity providing a service, product, search engine, advertisement, Reward or other feature that works with HUMFEE.

III. FORMATION OF THE AGREEMENT

Section 3

  1. These Terms are provided free of charge before the agreement is concluded, in a form that allows them to be saved and reproduced later.
  2. The agreement is concluded when the User expressly accepts these Terms in the installer or the Application. Creating an Account requires additional confirmation in the registration form. Participation in HUMFEE POINTS is voluntary and requires separate acceptance of its rules.
  3. Creating a HUMFEE Account requires acceptance of the current Terms.
  4. The Privacy Policy is informational. Providing it does not constitute a request for consent to all processing operations described in it.
  5. Optional consents, particularly for marketing, analytics not required for the Application to function, or personalised advertising, are collected separately.

IV. BETA TEST VERSION

Section 4. Nature of the Application

  1. HUMFEE may be labelled BETA / TEST / PREVIEW / EARLY ACCESS.
  2. This means the Application is under development, testing or optimisation.
  3. To the extent permitted by law, the BETA version is provided “AS IS” and “AS AVAILABLE”.
  4. These expressions describe the nature of a test version of the product and do not exclude User rights arising from mandatory law.
  5. The User acknowledges that the BETA version may, in particular:
    • contain errors;
    • operate unstably;
    • temporarily stop working;
    • require a restart;
    • not support certain websites;
    • not work with certain extensions;
    • contain unfinished features;
    • have limited compatibility;
    • change its appearance or operation;
    • include features that will later be removed.
  6. The Publisher does not promise that every experimental BETA feature will be included in the final version.
  7. The Publisher does not undertake to release a final version of the Application by a specified date.

V. BETA VERSION SHEET

Section 5

  1. The Publisher may publish a “BETA version sheet” for each significant BETA version.
  2. The sheet should specify, in particular:
    • supported operating systems;
    • minimum hardware requirements;
    • experimental features;
    • known significant limitations;
    • temporarily unavailable features.
  3. If a particular characteristic of the BETA version differs from what a User would normally expect of a service of this kind, that information should be presented clearly before the agreement is concluded.
  4. Where required by law, acceptance of that specific deviation must be express and separate.

The current BETA sheet is available as the “beta” document in the same version of the legal package. It describes the actual limitations of both platforms. A general BETA label does not waive statutory rights.

VI. HUMFEE FEATURES

Section 6

HUMFEE may provide, in particular:

Not every feature is necessarily available on every device or in every country.

VII. TECHNICAL REQUIREMENTS

Section 7

  1. Using HUMFEE requires:
    • a compatible device;
    • a supported operating system;
    • Internet access for network features;
    • sufficient memory;
    • up-to-date system components.
  2. Current technical requirements are published on the download page.
  3. The Publisher may end support for older systems or Application versions where justified by security, technological changes or the operating system manufacturer's end of support.

VIII. LICENCE

Section 8

  1. The Publisher grants the User a non-exclusive, limited and non-transferable licence to use HUMFEE on the User's own devices.
  2. The licence does not transfer copyright in the Application.
  3. The following are prohibited in particular:
    • distributing unauthorised modified versions of the Application;
    • impersonating the Publisher;
    • removing copyright notices;
    • circumventing safeguards;
    • interfering with Points calculation mechanisms;
    • using the Application unlawfully.
  4. These restrictions do not cover acts that are expressly permitted by mandatory law.
  5. Open-source components are governed by their respective licences, available in the “Licences / Open Source” section.

IX. UPDATES

Section 9

  1. HUMFEE may receive automatic updates.
  2. Updates may be introduced to:
    • improve security;
    • fix errors;
    • improve compatibility;
    • adapt to changes in law;
    • adapt to changes in external services;
    • develop features;
    • prevent fraud;
    • improve performance.
  3. Use of an outdated version may be restricted if necessary for the security of the Application, Users or infrastructure.

X. CHANGES TO THE SERVICE

Section 10

  1. The Publisher may change HUMFEE as a continuously provided service where justified by:
    • security;
    • changes in law;
    • changes in technology;
    • the need to fix an error;
    • changes to external APIs or operating systems;
    • prevention of abuse;
    • product development;
    • the need to maintain the economic viability of providing an additional free feature.
  2. A change must not result in additional costs for the User unless the law provides otherwise.
  3. Consumers will be informed of significant changes negatively affecting use of the service in accordance with applicable law.

XI. EXTERNAL WEBSITES

Section 11

  1. HUMFEE provides access to independent websites, applications and online services.
  2. The Publisher is not the owner or publisher of such websites merely because they can be opened in HUMFEE.
  3. Providers of external services are responsible for the content, goods and services they offer, in accordance with the law.
  4. A search result or link does not constitute a recommendation or guarantee by the Publisher.
  5. Users should also comply with the terms of the services they visit.

XII. SEARCH

Section 12

  1. HUMFEE may use search engines and APIs belonging to the Publisher or third parties.
  2. Search results may come from an external provider.
  3. The Publisher does not guarantee complete coverage of the Internet or the inclusion of every existing website in search results.
  4. The order of results may depend on the search provider's technology and policies.
  5. Sponsored content should be labelled so that it can be distinguished from ordinary results where required by law or the manner of presentation.

XIII. DOWNLOADING MATERIALS

Section 13

  1. HUMFEE may offer technical features for downloading materials.
  2. The mere technical ability to download material does not grant the User copyright or a licence to that material.
  3. Users should download and use materials only where doing so complies with the law and the terms of the relevant service.
  4. HUMFEE tools must not be used knowingly to infringe copyright or circumvent legally protected safeguards.

XIV. HUMFEE ACCOUNT

Section 14

  1. Some features may require an Account.
  2. Users should protect their login credentials.
  3. As a rule, one person may hold one Account participating in HUMFEE POINTS, unless the Publisher states otherwise.
  4. The following are not permitted:
    • selling Accounts;
    • buying Accounts;
    • creating fictitious Accounts;
    • creating multiple Accounts to acquire Points;
    • transferring an Account to circumvent limits.
  5. Users should promptly inform the Publisher if they suspect that an Account has been compromised.

XV. MINORS

Section 15

  1. A person under 13 may not independently create a HUMFEE Account requiring the conclusion of an agreement. An Account for such a User may be created or approved by a parent or guardian if HUMFEE provides an appropriate mechanism.
  2. Users aged 13–17 use their Accounts subject to the rules on legal capacity.
  3. Where a particular processing of a child's data is based on consent, HUMFEE may require a parent's or guardian's consent or approval for a child under 16.
  4. The Publisher may require a guardian's consent before delivering a Reward to a minor.
  5. Rewards requiring legal adulthood are not made available to minors.
  6. HUMFEE should not direct personalised advertising based on profiling at children.

XVI. HUMFEE POINTS

Section 16. Nature of Points

  1. HUMFEE POINTS are contractual units of the Program.
  2. Points:
    • are not a currency;
    • are not electronic money;
    • are not a cryptocurrency;
    • are not a financial instrument;
    • are not a deposit;
    • do not earn interest.
  3. Points cannot be paid out in cash unless the Publisher expressly establishes a Reward in the form of a monetary benefit in accordance with the law.
  4. Points cannot be sold or transferred between Users unless HUMFEE introduces an official transfer feature.
  5. Points serve only the purpose defined in the Program.

XVII. EARNING POINTS

Section 17

  1. Points may be awarded for Qualifying Activities specified in the Application.
  2. These may include:
    • actively using HUMFEE;
    • completing a specified number of valid searches;
    • using selected features;
    • regular activity;
    • participating in a promotion;
    • successfully referring a new User.
  3. Before an activity is performed, the Application specifies the number of Points available and the material conditions.
  4. The Publisher may set limits:
    • daily;
    • weekly;
    • monthly;
    • per device;
    • per Account;
    • per type of activity.
  5. Points may be credited after a delay resulting from verification.
  6. Points may have the following statuses:
    • pending;
    • awarded;
    • verified;
    • blocked;
    • redeemed;
    • cancelled;
    • expired.

XVIII. GENUINE ACTIVITY

Section 18

  1. HUMFEE POINTS rewards genuine User activity.
  2. The mere technical occurrence of an event does not automatically entitle the User to Points if the event was generated artificially.
  3. Qualifying Activity does not include, in particular:
    • automated searches;
    • repeating random characters to acquire Points;
    • mass refreshing;
    • artificially generating views;
    • bot activity;
    • activity performed solely by a script or macro;
    • events generated by manipulating the Application.

XIX. CHANGES TO POINT RATES

Section 19

  1. The number of Points awarded for future activities may change.
  2. The current value of an activity is shown in the Application.
  3. A change does not remove Points properly earned before it takes effect.
  4. The Publisher may organise temporary promotions, multipliers and bonuses.
  5. The conditions of a temporary promotion are provided before participation.

XX. REFERRAL PROGRAM

Section 20

  1. A User may receive an individual referral link or code.
  2. A successful referral is one meeting the conditions specified in the Application.
  3. Conditions may include, in particular:
    • installation of the Application by a new User;
    • creation of a new Account;
    • confirmation of the Account;
    • completion of a minimum amount of genuine activity.
  4. Merely clicking a referral link does not guarantee Points.
  5. The following are prohibited:
    • self-referrals;
    • fictitious registrations;
    • buying registrations;
    • bots;
    • mass Accounts;
    • impersonating other people;
    • misleading recipients about the nature of HUMFEE.
  6. The Publisher may limit the maximum number of rewarded referrals.

XXI. PREVENTION OF ABUSE

Section 21

The following are prohibited in particular:

  1. automating Points-related activity;
  2. manipulating the Application's code;
  3. falsifying device identifiers;
  4. deliberately changing system parameters to circumvent limits;
  5. creating device or Account farms;
  6. using emulation to increase Points artificially;
  7. obtaining a one-time bonus repeatedly;
  8. using a VPN, proxy or other technique to falsify location or circumvent Program rules;
  9. exploiting vulnerabilities or errors to obtain Points that are not due;
  10. interfering with communication between the Application and HUMFEE servers;
  11. selling or buying Points outside HUMFEE's official mechanism.

Using a VPN for ordinary privacy purposes is not itself prohibited.

XXII. VERIFICATION

Section 22

  1. The Publisher may use systems to detect abuse.
  2. Where abuse is reasonably suspected, the Publisher may:
    • temporarily pause Points accrual;
    • block Points redemption;
    • mark Points as pending;
    • request Account verification;
    • manually review events.
  3. The Publisher is not required to disclose the technical parameters of its anti-fraud system if disclosure would facilitate circumvention of safeguards.
  4. Verification should be proportionate to the nature of the suspicion and the Reward's value.
  5. The User may challenge the outcome of verification through a complaint.

XXIII. CORRECTION OF POINTS

Section 23

Points may be corrected or cancelled where:

  1. they were credited due to a technical error;
  2. they were credited twice;
  3. they were obtained through abuse;
  4. the activity was cancelled;
  5. the rules of a particular promotion were breached;
  6. the User exploited an error that they knew or reasonably should have known about.

A correction should correspond to the extent of the irregularity established.

XXIV. VALIDITY OF POINTS

Section 24

In the current version, HP do not automatically expire after 12 months. We do not introduce an expiry period retroactively. Any future expiry rules require prior notice, a new version of the rules and an expiry date disclosed before the affected HP are earned. Properly awarded Points remain in the Account after updates, rate changes and disabling new accrual. Deleting an Account at the User's request includes its HP, following an explicit warning.

XXV. REWARDS

Section 25

  1. Verified Points can be used in the HUMFEE Rewards catalogue.
  2. Rewards may include:
    • physical products;
    • digital codes;
    • vouchers;
    • gift cards;
    • discounts;
    • services;
    • premium features;
    • Partner Rewards.
  3. The catalogue may change.
  4. Each Reward states:
    • the number of Points required;
    • availability;
    • conditions for receipt;
    • any expiry date;
    • age or territorial restrictions.

XXVI. ORDERING A REWARD

Section 26

  1. Selecting a Reward submits an instruction to redeem Points.
  2. Points may be held during verification.
  3. The Publisher may carry out additional checks before delivering a higher-value Reward.
  4. The required Points are redeemed once the order is properly confirmed.
  5. If a Reward becomes unavailable before fulfilment is confirmed:
    • the Points are returned; or
    • the User may accept an alternative benefit.
  6. The Publisher does not unilaterally replace a Reward with a lower-value benefit.

XXVII. DELIVERY OF REWARDS

Section 27

  1. A digital Reward may be delivered:
    • in the Application;
    • by email;
    • through the Account;
    • through a Partner.
  2. A physical Reward is sent to the correctly specified address.
  3. Before dispatch, the User may be asked to provide the data necessary to fulfil the Reward.
  4. The Publisher may require additional data where necessary to meet a tax or legal obligation.
  5. The User is responsible for the accuracy of the data provided to the extent prescribed by law.

XXVIII. NO ELEMENT OF CHANCE

Section 28

  1. The basic HUMFEE POINTS Program is not a lottery or a game of chance.
  2. The User does not buy a chance to win a Reward.
  3. The User selects a Reward after obtaining the required number of Points and meeting the conditions.
  4. Draws, wheels of fortune, mystery rewards or other chance-based mechanisms may be launched only as separately legally reviewed campaigns.

XXIX. ACCOUNT SUSPENSION

Section 29

The Publisher may temporarily restrict an Account where necessary because of:

Measures should be proportionate to the risk identified.

XXX. TERMINATION, COMPLAINTS AND LIABILITY

Section 30. Termination and exclusion

An Account may be closed for a serious or repeated breach of these Terms. Where the breach can be remedied, the Publisher first requests that it cease. Immediate restrictions are permitted where required by security, law or the need to stop ongoing abuse. The User receives the reason, scope and duration of the restriction (where ascertainable), and information about the right to appeal. A restriction does not automatically mean the loss of all HP; corrections concern the irregularity established. Device ownership, a shared IP address or VPN use alone is not independent evidence of fraud. An appeal may be reviewed by a human.

The User may pause accrual, log out, uninstall the Application or delete the Account. Disabling accrual does not delete saved HP. Account deletion is a separate, confirmed operation covering Account data and HP, subject to exceptions required by law. Uninstalling is not deletion of the Account on the server. Terminating the agreement does not extinguish claims that arose earlier.

Section 31. Liability, AS IS and consumer rights

Software under testing is provided “as is” and “as available” to the extent permitted by law. The Publisher gives no additional guarantee of uninterrupted or error-free operation, complete detection of AI content, detection of all threats, or availability of every website and external feature. AI assessments are estimates; Users may challenge their results. Users should keep backups of important data.

These qualifications do not exclude or limit liability that cannot be excluded by agreement, in particular liability to consumers for the conformity of digital content or a digital service with the agreement, mandatory updates, intentionally caused damage, and data protection breaches. We do not require users to waive consumer rights or accept unspecified deviations. Users retain the right to require the service to be brought into conformity with the agreement and to exercise further remedies provided by law. Provisions more favourable to consumers under the law of their habitual residence continue to apply.

In relationships with businesses not entitled to consumer protection, liability for lost profits is excluded to the extent permitted by law. This exclusion does not cover intentional misconduct or other cases in which legislation prohibits limiting liability. The Publisher is not responsible for independent third-party content merely because the browser can open it, but remains responsible for its own obligations and actions in accordance with the law.

Section 32. Complaints and withdrawal

Complaints may be sent to support@humfee.com. It is sufficient to describe the problem, approximate time, Application version, requested remedy and preferred response method. Do not send passwords, recovery codes or Reward keys. The private reporting feature in the community section may be used; having an Account is not a condition for submitting a complaint. We respond to consumer complaints within 14 days, taking into account the legal consequences of failing to respond. Statutory rights are not limited by a deadline intended for technical reports.

Where a statutory right to withdraw from a distance agreement applies, consumers may exercise it within 14 days of concluding the agreement by sending an unambiguous statement. Installation or acceptance of these Terms alone does not constitute consent to lose this right. Example: “I withdraw from the HUMFEE agreement concluded on …; Account or contact information for identification …; full name …; date …”. The option to end free use and delete the Account also remains available after this period.

Consumers may seek assistance from a municipal or district consumer ombudsman and use appropriate out-of-court dispute resolution methods. Information is provided by UOKiK, the Polish Office of Competition and Consumer Protection. We do not impose exclusive jurisdiction of the court at the Publisher's registered office. Personal data complaints may be lodged with the President of UODO, the Polish Personal Data Protection Office, or the competent supervisory authority.

Section 33. Changes to the Program and documents

Reasons for changes include security, changes in law, fixing an error, changes to operating systems or Partner services, and justified development of the service. Changes must not arbitrarily remove properly earned HP or worsen a confirmed order. Rate changes apply to future activities; accepted mission conditions remain in force. We do not introduce charges without a separate order from the User.

We provide appropriate advance notice of a material change that worsens use, on a durable medium, explaining the change, its timing and available rights. Where digital service rules apply, consumers may terminate the agreement within 30 days of receiving the notice or the change being made if the change significantly and negatively affects access or use, subject to statutory exceptions. We do not treat silence or an update alone as acceptance of a new version.

Ending the Program requires advance notice and a realistic period for redeeming properly earned HP, taking into account the availability of benefits and acquired rights. A security intervention may be immediate to the extent necessary. Each document has a version; earlier versions remain available for downloading and reproduction. Where information about Points conflicts, the specific activity conditions accepted by the User and the User's statutory rights apply.

The Application obtains current documents from the server without requiring reinstallation. Released legal packages are digitally signed and saved for offline use. Each new version requires express acceptance; downloading or updating does not constitute consent.
